By accessing or using the TalentLink platform ("Platform") as a healthcare facility ("Facility," "You"), you agree to be bound by these Facility Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Platform Services

TalentLink provides a platform to connect healthcare facilities with qualified nursing professionals ("Nurses") for temporary work assignments ("Shifts"). TalentLink acts as an intermediary and does not directly employ Nurses, unless otherwise specified.

3. Facility Obligations

• You are responsible for providing accurate and complete information about your facility and shift requirements.
• You agree to provide a safe and compliant working environment for Nurses.
• You are responsible for verifying Nurse credentials and suitability for specific assignments, although TalentLink may provide credential verification services as part of the Platform.
• You agree to adhere to all applicable labor laws and regulations concerning the engagement of temporary nursing staff.

4. Shift Posting and Fees

You may post Shifts on the Platform, detailing requirements, pay rates, and duration. Fees for using the Platform and for successful Shift placements will be communicated to you separately or as part of your service agreement with TalentLink. You agree to pay all applicable fees in a timely manner.

5. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged through the Platform or during the course of an engagement.

6. Limitation of Liability

TalentLink is not liable for the conduct or performance of Nurses, nor for any damages arising from the services provided by Nurses, except as required by law. Our liability is limited to the amount of fees paid by you to us in the preceding 12 months.

7. Termination

TalentLink reserves the right to suspend or terminate your access to the Platform at any time, with or without cause. You may terminate your account in accordance with your service agreement.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Jurisdiction], without regard to its conflict of law principles.
