By accessing or using the TalentLink platform ("Platform") as a nursing professional ("Nurse," "You"), you agree to be bound by these Nurse Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Platform Services

TalentLink provides a platform to connect qualified nurses with healthcare facilities ("Facilities") for temporary work assignments, including per diem, local, and travel shifts ("Shifts"). TalentLink is not an employer of nurses but acts as an intermediary.

3. Nurse Obligations

• You represent and warrant that all information provided during your application and on your profile is accurate, current, and complete.
• You are responsible for maintaining the validity of your nursing license, certifications, and any other required credentials.
• You agree to perform services for Facilities in a professional and competent manner, adhering to all applicable laws, regulations, and facility policies.
• You are responsible for your own professional liability insurance, unless otherwise specified for a particular shift or engagement.
• You understand that you are an independent contractor and not an employee of TalentLink or the Facilities, unless explicitly stated otherwise in a separate agreement for a specific assignment.

4. Shift Booking and Payment

Shift details, including pay rates, duration, and specific requirements, will be provided for each available Shift. By accepting a Shift, you agree to the terms specified for that Shift. Payment terms, including rates and payment schedules (e.g., InstantPay eligibility), will be outlined in the Shift details or your agreement with TalentLink. You are responsible for any applicable taxes on your earnings.

5. Confidentiality

You may have access to confidential patient information and facility proprietary information. You agree to maintain the confidentiality of such information in accordance with applicable laws (e.g., HIPAA) and facility policies.

6. Limitation of Liability

TalentLink is not liable for any damages arising from your use of the Platform or your provision of services to Facilities, except as required by law. Our liability is limited to the amount of fees paid by you to us, if any, in the preceding 12 months.

7. Termination

TalentLink reserves the right to suspend or terminate your access to the Platform at any time, with or without cause. You may terminate your account by discontinuing use of the Platform.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Jurisdiction], without regard to its conflict of law principles.
